Thos. Sudborough and others to Matthew Langley

This 1923 aerial photograph shows a block of properties with the long
malthouse prominent on the left. This and the surrounding properties
are all mentioned in a series of indentures and wills now owned by
Burton Latimer Heritage Society. Some of the premises mentioned in
the document below may have been demolished to make way for them

Mortgage of a Messuage in Burton Lattimer to secure £18 In Trust and Covenant to convey said Premises to Mary Sudborough for life on the event therein mentioned dated 23rd Novr. 1801

Thos. Sudborough & Others to Mr. Matthew Langley - This Indenture Quinquepartite made the twenty third day of November in the forty second Year of the Reign of our Sovereign Lord George the Third by the Grace of God of the United Kingdom of Great Britain and Ireland King Defender of the Faith and so forth and in the Year of our Lord one thousand eight hundred and one Between Thomas Sudborough of Burton Lattimer in the County of Northampton Cordwainer and Mary his wife of the first part Joseph Sudborough Son of the said Thomas Sudborough of the second part Edmund Eady of Burton Lattimer aforesaid Yeoman of the third part Joseph Sudborough of Burton Lattimer aforesaid Shopkeeper Brother of the said Thomas Sudborough and eldest Son and Heir at Law of Thomas Sudborough late of Burton Lattimer aforesaid Cordwainer deceased of the fourth part and Matthew Langley of Burton Lattimer aforesaid Yeoman of the fifth part Whereas Thomas Sudborough late of Burton Lattimer aforesaid Cordwainer deceased by Will bearing date the ninth day of November one thousand seven hundred and eighty seven devised to his Son the said Thomas Sudborough party hereto and his assigns for his life the Hereditaments hereinafter mentioned and from and after his decease in case the Testator’s Grandson Joseph Sudborough party hereto (Son of the said Thomas the Son) should be then living the Testator devised the same unto his said Grandson his Heirs and Assigns but in case his Grandson should happen to depart this Life in the Lifetime of his said Father then he devised the same from and after the decease of the said Thomas unto his the Testator’s own right Heirs for ever And whereas the said Thomas Sudborough party hereto by Indenture of Feoffment bearing date the twenty third day of January one thousand seven hundred and ninety five in Consideration of Six Pounds and six shillings to him paid by the said Edmund Eady Did sell and enfeoff unto the said Edmund Eady the said Hereditaments To Hold unto the said Edmund Eady and his Assigns for the Life of the said Thomas Sudborough  party hereto And Whereas the said Thomas Sudborough hath since contracted with the said Edmund Eady  for the repurchase of the said Hereditaments at and for the price or Sum of Six Pounds sixteen shillings and six pence which sum hath been paid to the said Edmund Eady as he doth hereby acknowledge and the said Indenture of Feoffment hath been delivered up but no Reconveyance of the said Hereditaments hath been made by the said Edmund Eady And Whereas the said  Joseph Sudborough the Grandson hath applied to his Father the said Thomas Sudborough party hereto to procure him the Loan of the Sum of Eighteen Pounds to set him up in Business which the said Thomas Sudborough party hereto hath consented to do on his said Son’s agreeing to convey the said Hereditaments to Mary the wife of the said Thomas Sudborough party hereto for the Term of her natural Life in case he the said Joseph Sudborough the Grandson shall survive his said Father and the said Matthew Langley hath consented to advance and lend the said sum of Eighteen Pounds on the Securities hereinafter contained  Now this Indenture witnesseth  that for and in Consideration of the Sum of Eighteen Pounds of lawful Money of Great Britain to the said Joseph Sudborough the Grandson paid by the said Matthew Langley at or before the sealing and delivery hereof The Receipt whereof is hereby acknowledged and also in Consideration of Five Shillings to the said Thomas Sudborough party hereto Edmund Eady and Joseph  Sudborough the Shopkeeper paid by the said Matthew Langley The Receipt whereof is also hereby acknowledged They the said   Thomas Sudborough party hereto Joseph Sudborough the Grandson Edmund Eady and Joseph Sudborough the Shopkeeper have and each of them hath granted bargained sold and demised and by these present Do and each of them Doth (according to their several Estates and Interests of and in the Hereditament aforesaid) grant bargain sell and demise unto the said Matthew Langley his Executors Administrators and Assigns All  that Messuage or Tenement in Burton Lattimer aforesaid now in the occupation of the said Thomas Sudborough party hereto and which was devised by the said Thomas Sudborough deceased and afterwards conveyed to the said Edmund Eady as aforesaid Together with the Appurtenances to the same belonging And the Reversion and Reversions Remainder and Remainders Rents Issues and Profits thereof and all the Estate Right Title Interest Use Trust Property Claim and Demand whatsoever of them the said Thomas Sudborough party hereto Joseph Sudborough the Grandson Edmund Eady and Joseph Sudborough the Shopkeeper and each and every of them of in to or out of the said Premises To have and to hold the said Messuage or Tenement with the Appurtenances above granted and demise or intended so to be unto the said Matthew Langley his Executors Administrators and Assigns from henceforth for and during and unto the full end and term of One Hundred Years Yielding and Paying therefore Yearly and every Year during the said Term unto the Person or Persons for the time being intitled to the Freehold or Inheritance of the said Premises the Rent of One Pepper Corn only on the Feast of Saint Michael the [*]el (if lawfully demanded) Provided nevertheless and these presents are upon this express Condition that if the Person or Persons who for the time being shall be intitled to the [*] Inheritance of the said Premises shall and do well and truly pay or cause to be paid unto the said Matthew Langley his Executors Administrators or Assigns the Sum of Eighteen Pounds of lawful Money of Great Britain with all lawful interest for the same on the twenty third day of March now next ensuing with making any deduction or abatement thereout  [*] from thenceforth these presents and every thing herein contained shall cease And the said Thomas Sudborough party hereto and Joseph Sudborough the Grandson do and each of them [*]intly and severally for themselves their Heirs Executors and Administrators covenant promise and agree to and with the said Matthew Langley his Executors Administrators and Assigns th[*] the said Thomas Sudborough party hereto and Joseph Sudborough the Grandson or one of them their or one of their Heirs Executors Administrators or Assigns shall and will well and truly pay or A[*] to be paid unto the said Matthew Langley his Executors Administrators Assigns the Sum of Eighteen Pounds of lawful money of Great Britain together with all lawful Interest for the same at the day and time and in manner hereinafter appointed for payment thereof And also that if default shall happen to be made of or in  Payment of the said Sum of Eighteen Pounds or the Interest thereof contrary to the Intent of the aforesaid Proviso and Covenant then and at all times afterwards it shall be lawful to and for the said Matthew Langley the  Executors Administrators or Assigns to enter and come into and upon have hold occupy and enjoy the Hereditaments herein before granted and demised and to receive and take the Rents Issues and Profits thereof to and for his and their own use and benefit for all the residue which shall be then to come of the said Term of One Hundred Years without any Suit or Interruption of or by them the said Thomas Sudborough party hereto Joseph Sudborough the Grandson Edmund Eady or Joseph Sudborough the Shopkeeper their Heirs or Assigns And it is hereby agreed and declared that until default shall be made in payment of the said Sum of Eighteen Pounds and Interest as aforesaid it shall be lawful for the Person or Persons intitled to the Freehold or Inheritance of the said Hereditament  for the time being to hold and enjoy the said Premises above granted and demised and receive and take the Rents issues and profits thereof to his her and their own proper use And the said Joseph Sudborough the Grandson doth hereby for himself his Heirs Executors and Administrators covenant promise and agree to and with the said Mary Sudborough his Mother that in case he the said Joseph Sudborough the Grandson shall outlive his said Father and thereby become seized of or intitled to the Freehold and Inheritance of the said Premises or the Equity of Redemption thereof then that he shall and will as far as he lawfully or equitably can or may convey and assure unto his said Mother Mary Sudborough and her Assigns  a good Estate of Freehold of and in the said Premises for and during the Term of her natural Life In Witness whereof the parties first above named to these presents have interchangeably hereunto subscribed and set their Hands and Seals the day and year first above written

Received the day and year first within written of and from the within named Matthew Langley the Sum of Eighteen Pounds being the Consideration money within expressed to be paid by him to me I say received the same by me
