Property Indenture 1789
John Harpur Esq. to William Eady

Premises on the site of the indenture premises
This 1923 aerial photograph shows a block of properties with the long
malthouse prominent on the left. This and the surrounding properties
are all mentioned in a series of indentures and wills now owned by
Burton Latimer Heritage Society. Some of the premises mentioned in
the indenture below would have been demolished to make way for them

Indenture. John Harper Esq. to William Eady feoffment dated November 6th 1789

This Indenture made the Sixth day of November in the twenty ninth Year of the Reign of our Sovereign Lord George the Third by the Grace of God of Great Britain France and Ireland King Defender of the Faith and so forth And in the year of our Lord one thousand seven hundred and eighty nine Between John Harper of Burton Lattimer in the County of Northampton Esq. of the one part and William Eady of Burton Lattimer aforesaid Yeoman of the other part Witnesseth that for and in consideration of the sum of Twenty five pounds ten shillings and six pence of lawful money of Great Britain to the said John Harper in hand well and truly paid by the said William Eady at or before the ensealing and delivery of these present The Receipt whereof he the said John Harper doth hereby acknowledge and thereof and therefrom doth acquit release and discharge the said William Eady his Heirs Executors Administrators and Assigns and any of them for ever by these presents he the said John Harper hath granted bargained sold enscossed assured and confirmed and by these presents Doth grant bargain sell aliene enfeoff assure and confirm unto the said William Eady His heirs and Assigns for ever All that little Tenement or Dwellinghouse with the Appurtenances thereunto belonging containing two Bays of Building or thereabouts situate standing lying and being in Burton Lattimer aforesaid And also all that Barn containing about one Bay of Building with the Yard thereunto adjoining and belonging which said premises were amongst other Tenements and Hereditaments bought and purchased by Edmund Eady of and from Ann Coleman Widow and John Coleman her Son and are now or were late in the tenure and occupation of Job Keach Weaver his Assignee or Assigns and do lye near or adjoining to a Cottage House or Tenement in Burton Lattimer aforesaid heretofore in the tenure or occupation of John Meadows and now of Thomas Wood and which was formerly the Estate of William Whittle deceased and by him sold and conveyed together with the said herby granted premises and other Tenements and Hereditaments to the said John Coleman deceased and with said premises hereby granted and enfeoffed were granted and enfeoffed by the said Edmund Eady to the said John Harpur in and by a certain Indenture of Feoffment bearing date on or about the Ninth day of February which was in the year of our Lord one thousand seven hundred and seventy eight Together with all and singular Houses Outhouses Edifices Buildings Yards Gardens Orchards Backsides Walls Hedges Ditches Mounds Fences Freeboards Ways Sigates Paths Passages Easements Profits Commodities Advantages Emoluments Hereditaments and Appurtenances whatsoever to the said Little Tenement or Dwellinghouse Barn yard and Premises hereby granted belonging or in anywise appertaining or accepted reputed or known as part parcel or member thereof And the Reversion or Reversions Remainders or Remainder Rents Issues and Profits thereof And also all the Estate Right Title Interest Benefit Property Gain and Demand whatsoever of him the said John Harper  of in or to the same Premises or any part thereof To have and to hold the said Little Tenement or Dwellinghouse Barn and Yard and all other the Premises hereby granted and enfeoffed or mentioned or intended so to be with their and every of their appurtenances unto the said William Eady  his Heirs and Assigns  for ever. To the only proper use and behoof of the said William Eady his Heirs and Assigns for ever and to and for none other use intent or purpose whatsoever And the said John Harper his heirs executors and administrators all the said hereby granted and enfeoffed hereditaments and premises with the appurtenances unto the said William Eady his heirs and assigns against him the said John Harper and his heirs and against all and every other person and persons whomsoever claiming or to claim by from or under him or them shall and will Warrant and for ever defend by these presents And the said John Harper for himself his heirs executors administrators and assigns doth hereby Covenant Promise Grant and Agree to and with the said William Eady his heirs and assigns by these presents in manner following that is to say that he the said John Harper now is and standeth lawfully rightfully and absolutely seized in his demesne as of Fee simple of a good sure perfect absolute and indefeasible Estate of Inheritance of and in all and singular the said premises hereby granted and enfeoffed or intended so to be with their and every of their appurtenances And now hath in himself good right true title and lawful and absolute authority to grant and enfeoffe the same unto the said William Eady his Heirs and Assigns for ever in manner aforesaid and according to the true intent and meaning of those presents And also that it shall and may be lawful to and for the said William Eady his heirs and assigns from time to time and at all times hereafter peaceably and quietly to enter and come into and upon have hold use occupy possess and enjoy the said premises hereby or intended to be hereby granted and enfeoffed and every part thereof with the appurtenances and to receive and take the Rents Issues and Profits thereof to and for his and their own use and benefit without any the lawful Set Suit Trouble Hindrance Denial Interruption or Molestation Claim or Demand whatsoever of or by him the said John Harpur his heirs or assigns or any other person or persons whomsoever claiming or to claim by from under or In trust for him or them and that free from all Incumbrances whatsoever by him or them done or committed And Lastly that the said John Harpur & his heirs & all others claiming or to claim by from or under or In trust for him or them shall & will from time to time & at all times hereafter upon the request & at the cost & charges of the said William Eady his heirs or assigns make & execute all such further assurances in the Law whatsoever for the better & more perfect assuring of the said premises into & to the use of the said William Eady his heirs & assigns As by the said William Eady his heirs or assigns or his or their counsel learned in the Law shall be lawfully & reasonably advised devised & required In Witness whereof the Parties first above named have interchangeably hereunto put their hands & seals the day & year first above written
